You need to hire a DWI trial attorney. The DA will never dismiss on their own. Also, just because there is no breath test doesn't mean they can't make loss of mental and physical faculties.

I have helped people in this situation without a return. First is make sure you know why you are being denied a license. Often it is just an OJW fee or court costs - both of which can be paid via credit card to the court clerk in the county where you arrested.

Your license can be suspended either as a result of an administrative action at the DMV (if the blood results come back at .08 or above) or as a result of the outcome of the criminal case. So the short answer is yes, you are still facing a possible suspension.
