How long does it take to get a blood test back this happen January 6th 2013 and court is February 5th 2013?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
DUI/DWI lawyer at Richard B. Jacobson Associates, LLC
The court hearing set for February is probably simply an Initial Appearance. While you should get the results of the blood test within a few weeks, if the case is in its early stages it probably will not much matter. You really should consult a lawyer.

What are my chances that I can get this DUI set aside in court?

Without any blood or breath test, the prosecutor can still proceed, but they will have a much more difficult task than if they had scientific proof. Now, all they have is the opinion of the officer. I have won cases like that, but you are not guaranteed to win. Every case is different. In this case, important factors will be the apparent credibility of you, and the apparent credibility of the officer, in the eyes of the jury. The goal is to get a not guilty verdict from the jury. Once you are convicted, it normally will be very difficult to get that conviction overturned.

How long is a license taken away after the first DUI offense?

Gregory Casale
Answered by attorney Gregory Casale (Unclaimed Profile)

There are different forms of suspension. The administrative suspension if for either failing the breath test (BT) or refusing to take it. For a 1st offense with the person over 21 it is 30 days for failure and 180 for refusal. Then there is the judicial suspension which is from the court at the time of disposition. Upon an admission or a finding of Guilty, again for a 1st offense and person 21 or over the loss is 45 to 90 days. All numbers jump substantially for 2nd, 3rd, 4th, etc. offenses.
