Florida doesn't care if you are driving or?moving; the issue is whether you are in "actual physical control". Most Judges say that if you are asleep in a car (front or back seat) and the keys are in the cabin then you re in APC.

Can I be charged with a DUI if the keys were outside of the car and the arresting officer smelled?

Florida law doesn't care about the keys. Our statute says if a person is in "actual physical control" of the vehicle they can be arrested for DUI. Sleeping in the back seat of a car, keys with someone else a person can be arrested and found guilty. Unfair? Yes, talk to the democrats in the legislature they passed the law and block any changes.

Can I get a Florida drivers license if I have an OWI in Wisconsin but give them my California license?

Don't mess with the drivers license office, it is a felony to commit fraud upon the drivers license office. If you have a charge in Wisconsin, own up to it, and disclose it. If your last license was in Wisconsin, then disclose it.  You will either get a license or you wont, and you should not misrepresent anything.  It is possible that Florida will give you a license or perhaps a restricted or business only license. Be honest please.
