It does happen fairly often. Generally the liability for the offense falls on the driver, not the owner. If he caused any injury or damage to property as a result of his drunk driving, then your insurance company should be involved. If on the other hand you let him drive with any knowledge that he was likely to get drunk and drive, and if he is underage, you may have some liability. Perhaps your husband has a good point in not permitting your son to drive his car, You might want to do the same, or get a no-alcohol-if-driving pledge from your son, and if he is young enough, ground him from driving for enough time for him to feel the loss. Generally the Statute of Limitations is 3 years. The scenario makes me wonder if you were given a blood test. If so it would explain the delay in deciding if charges would be filed. You should continue to check the court docket and if you did take a blood test, probably contact an attorney now to be prepared.

It doesn't have to be an officer who sees you driving. An independent witness is good enough. If that person saw you driving and followed you home and is able to identify you and the vehicle, you are in for a potentially difficult case. A 0.19 is more than 2x the legal limit. That alone is going to make dealing the case difficult. Having said this, it is possible to deal any case, if the facts of the case warrant the dealing. Without knowing more about the facts specific to your case, I cannot say. My advice, retain the services of an attorney, who can review the facts of your case and advise you accordingly.
