Blood tests for marijuana will either show active THC or Carboxy THC. Carboxy THC is the metabolized by-product of active THC that stays in your system for days or weeks. Just having Carboxy THC in your system will not support a DUI prosecution.

The first person probably won't be charged with a crime, but could be liable in a civil lawsuit. The second person can be charged with driving while intoxicated.
