Will having to put an ignition immobilizer stop me from early probation termination?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
You should discuss this with your attorney. If the ignition interlock is a term and condition of your sentence, likely you will not be able to get your probation terminated early. An attorney in your area may be able to help answer your question.

Is there anything I can do to overturn a guilty DUI verdict?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)

Your remedies are either a Motion for New Trial, and/or an Appeal. If you think you can prove valid grounds to justify either, and if you are still timely in doing so [sixty days for filing a Noticion of Appeal, ten for the Motion], and if you are serious about investing the necessary fees and costs and hiring counsel to help in this, feel free to contact me to arrange a consult to review and determine whether sufficient mistakes of fact or law were made to provide the necessary basis.

What usually happens when you get two DUI's close together?

default-avatar
Answered by attorney Steven Joseph Pisani (Unclaimed Profile)
DUI/DWI lawyer at The Law Offices of Steven J. Pisani, LLC
The law in Colorado states that when a second offense for DUI occurs within 5 years of a prior offense, the sentence imposed by the court must be completed in the county jail. If this was your first and second DUI's, then you be facing a minimum of 30 days jail. There are many reasons why that sentence would be harsher though: the short time between the two cases, possible violation of probation or bond and lack of maintaining sobriety. Basically, you could be looking at a very severe sentence from the court. Hiring an experienced criminal defense and DUI attorney is imperative.
