I had 3 DUI back when they had the 10 year rule and I was over that so I wasn’t charged for a felony back then is this correct?

No. You likely signed a document stating that you were pleading guilty to a misdemeanor and additionally the judge signed a judgement stating the exact level of offense and the punishment for that offense.

New Mexico? I am in Texas. Have no idea about New Mexico law or how you got on a Texas list. I would google DWI trial lawyer in your area and go meet with them. Research the hell out of them and go with who makes you most comfortable and who you can afford.

Proof beyond a reasonable doubt that a person: (1) lost the normal use of their mental faculties; (2) lost the normal use of their physical faculties; or, (3) had a bac over .08.
