What am I looking at on a felony DUI and child endangerment and should I take it to trial?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
He has a brain injury but yet you say he's fine? I doubt he would agree with your assessment on that. No one is saying you did it on purpose, nevertheless, that doesn't change the fact it happened. I can understand you being scared but I found your attitude offensive. DUIs involving injury are serious crimes and prosecutors rarely give deals. You need to invest in an experienced DUI attorney to thoroughly review your case to see if any motions can be filed and what your best options are.

Can I win a DUI case if it is my first offense and I was sitting in a parked car on private property?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. The important questions are when were you drinking before arriving at the parking lot? What was your BAC level? Why did the police stop and investigate? I suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. He or she would then be in a better position to analyze your case and advise you of your options.

What are some possible outcomes? Are marijuana DUI cases for the prosecutor?

Blood tests for marijuana will either show active THC or Carboxy THC. Carboxy THC is the metabolized by-product of active THC that stays in your system for days or weeks. Just having Carboxy THC in your system will not support a DUI prosecution.
