Ultimately, in order to be "convicted" in court for Driving Under the Influence "DUI" in California you must have proof beyond a reasonable doubt that you had been driving. However, police have the right to "arrest" someone for DUI under a lesser standard of "probable cause" to believe someone was driving. For instance, if you were found behind the wheel, keys in the ignition, engine warm, or admitted to driving earlier, etc. the officers could arrest you for DUI. Another possibility is that you could also be arrested for "Public Intoxication" under California Penal Code section 647 (f) for being "drunk" in a public place. An experienced DUI attorney would need to be consulted about the specific facts of a case. After drinking, if you ever plan on "sleeping it off" somewhere, do not do it in a vehicle.
