In situations where your CA license is on hold or suspended because of an action taken by another state, the best way (and typically the only way) to resolve the situation in California is to do whatever is necessary in the other state so that the hold or suspension in the other state is released. If you have an out-of-state DUI offense you will be required to resolve that matter in the other state before CA DMV will allow you to get a license.

If you are still timely and able to do this, and if there are actual legal grounds for the action, and if you are willing to spend the thousands of dollars in fees it will cost for this, and if you are willing to sign a Retainer Agreement and disclosure documents acknowledging that you understand there is no guarantee of success and in fact a very high likelihood of loss, then we can talk. You can't go into this thinking just because you disagree with the outcome that you are somehow entitled to win. You'll have to prove the hearing officer made a substantial mistake of fact or law in the decision, outside his allowed range of discretion and judgment.

Does it make a difference if I was not driving when I was arrested for DUI?

Yes and no. It does not matter if you were driving when you were arrested. In only matters if you were driving when you were impaired. You can certainly be lawfully arrested even if you were not driving at the time. However, in order to actually convict you of DUI the DA must still show you were driving. This can be shown through circumstantial evidence. Who had the keys? Did someone report the accident and can place you behind the wheel? In what name is the vehicle registered? How long after the accident did authorities arrive? Was anyone else in the vehicle? Could a separate individual have driven and crashed the vehicle and then successfully fled the scene? All of these questions would have to be answered to the satisfaction of the jury. Good luck.
