CanI beat a DUI case if nothing was in my system but found cocaine in the car?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
You should not be charged with DUI - if no substance that could impair you was found in your system. However- you most likely would be charged with simple possession, if the search could be thrown out depends on what the officer will testify to, if you gave him consent to search- then no. If you did nit give consent to search, it would depend on what reasons the officer gives for the search.

Can I be charged with refusal if the officer ticketed me on it?

In SC, if you are referring to refusal to submit to breath and/or bodily fluid testing and the charge is plain DUI, then yes, the State can allege that you refused to submit to testing under certain conditions. These conditions are very highly contested in the legal arena right now and there are technical arguments in regards to a lot of them right now. You should consult in person with an attorney as soon as possible regarding these matters. I do hereby clearly advise against any reliance on the information as advice or application of it to a specific situation without a more thorough consultation with counsel.

What is the likelihood that a field administered breath test and a blood test administered in a clinic will render the same BAC result?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
If the numbers are identical there is a strong likelihood that you were absorbing and/or shifting from absorption into elimination which means that breath numbers are likely overstated. You need a lawyer and a forensic toxicologist and likely a jury trial to walk away from this defensible case.
