Is there a statue of limitations on being charged with a suspected DUI and haven't had to appear in court and it is almost 1 year?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
The statute of limitations is not running. You explained that the attorney has appeared in court, correct? That means there is an indictment or accusation, which means that the statute of limitations has ceased to run. Your case is going forward. Your attorney has foolishly decided to save you some time and trouble by not having you appear, but you are the type of client that needs to appear at all court dates. Let your attorney know that you need to appear, and you will see your case is going forward, and statute of limitations is a non-issue.

Does a DUI show up on background check for employment?

Answered by attorney Philip Daniel Hache
DUI/DWI lawyer at Law Offices of Phil Hache
Yes, a DUI conviction will show up on a background check for someone searching for misdemeanor or felony convictions. There is some action that you can take for employment purposes though. It is possible to get a DUI conviction dismissed once probation is terminated. It is even possible to terminate probation early in some circumstances. There are some limitations to this, but if successful the conviction gets withdrawn and dismissed, and would not have to be reported to a large portion of employers/potential employers.

Will my DUI in one state count against me in another state?

Answered by attorney Alison Lee Bermant (Unclaimed Profile)
DUI/DWI lawyer at Alison Bermant, Attorney at Law
They could possibly be used if the prosecuting attorney finds the priors on a criminal history check (DUI's are not just on your driving record but also on a criminal record if reported) and the elements of Georgia's DUI law are the same as California's and they are within the past 10 years. It is a very good idea to have a lawyer in the area working for you in the event those priors are not found at first glance as the difference between a first offense and a fourth offense in California is a felony and significant jail time.
