You need to send what is often called a "discovery request," or request entry of an "Order Granting Discovery," and serve the prosecutor or the police department with the request for the Breathalyzer maintenance and test log data.

You can, but there is also an alternative option of a 14 day in-patient treatment. Speak to a lawyer. Without speaking to a lawyer, you do not know your options. You may be able to beat the charge outright.

Will they continued it aging the DUI blood test for another date if test is not in yet?

Answered by attorney Edward Jerome Blum (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Edward J. Blum
If they haven't tested blood yet there's a really really good chance that when they do it will be contaminated by fermentation in the sample. This makes the results meaningless as no one can tell what if any alcohol is from drinking and what is from fermentation. Studies show fermentation can raise the BAC .10-.20.
