Is sleeping in car after drinking, keys on the floor, against the law in California?

Answered by attorney Donald Guy Sowers (Unclaimed Profile)

Ultimately, in order to be "convicted" in court for Driving Under the Influence "DUI" in California you must have proof beyond a reasonable doubt that you had been driving. However, police have the right to "arrest" someone for DUI under a lesser standard of "probable cause" to believe someone was driving. For instance, if you were found behind the wheel, keys in the ignition, engine warm, or admitted to driving earlier, etc. the officers could arrest you for DUI. Another possibility is that you could also be arrested for "Public Intoxication" under California Penal Code section 647 (f) for being "drunk" in a public place. An experienced DUI attorney would need to be consulted about the specific facts of a case. After drinking, if you ever plan on "sleeping it off" somewhere, do not do it in a vehicle.

You must submit to breathalyzer or blood test or your license will be suspended for one year. Yes you can still be charged with DUI.

Will I have to pay or go to jail for running away from the police?

Answered by attorney George E Downing (Unclaimed Profile)
DUI/DWI lawyer at George E. Downing, Jr. Attorney at Law
When a uniformed police officer identifies himself and ask you to stop, you must do so. Because you failed to do so, you face the possibility of probation, fine, and or jail sentence. If you have no prior record, there was a possibility that an attorney may be able to get you into a pretrial intervention program with the prosecutor.
