No. It takes a 3rd charge to elevate the crime to a felony, and the time limit for the occurrence of the first 2 charges is 7 years not 10 and there is no time limit as to when the 3rd offense must occur for it to be classified as a felony.

If you were cited for driving without a license and failed to appear, you likely have a suspended license now. Failure to appear usually results in the issuance of a bench warrant and a "failure to appear" which then results in both a warrant for your arrest and the suspension of drivers license. You must do something to handle the ticket, it doesn't just go away. A DUI attorney can help you move through this process.

On a 3rd DUI in WA State a person is either looking at 90 days in jail or 120 days in jail depending on the BAC level. 14 and lower (90 days) and .15 and higher or a refusal of the BAC machine (120 days). There is in addition electronic home monitoring the person has to pay for on top of the jail and do lower limit 90 days EHM or 120 days higher limit. These EHM amount can be converted to an added 8 days lower limit and 10 days higher limit of jail time.
