Is it legal to be charged with OWI if the car is not turned on and you are standing next to it?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
In Utah, yes, that it legal. The police need to have reason to believe that he had actual physical control of the vehicle. If he had just finished driving it or if they believed he was about to drive it, that would give the police sufficient reason.

Am I responsible for the alcohol and does it matter if it's my car or not?

How stupid of your friend to smoke pot in the car. If you are driving and the car reeks of pot and the police find any remnants, even a seed, anything they can test, you could be found in possession of marijuana. You are the driver I doubt if your pot smoking friend will go to court and tell them that the pot was his. If you smoke it at all, it can stay in your blood for up to 30 days. If you are stopped and they find any remnants or smell the marijuana scent, you could be arrested for driving under the influence and if a blood test detects any amount of marijuana in your system, you could get convicted of driving under the influence of marijuana.

Should I get an appellate attorney or not?

J Matthew Catchick

Winning a DUI appeal is very difficult, and quite costly (easily $5,000.00 plus). If the officer had a valid reason to stop you (i.e., you were driving in the middle of the street), and if the blood test or Breathalyzer were properly administered/maintained, you might be better off saving your money to hire an attorney to restore your driving privileges after your period of revocation has expired.
