Some CA convictions can be 'expunged' from criminal records by proper application and Petition to the court, but only IF there was no felony prison time sentenced whether served or not, and if it was not for certain listed sexual crimes, and if all terms of sentencing and at least one year of probation are completed, and if there are no new charges pending.

the level is within the range which would cause the municipal prosecutor to move to a lesser charge if you could demonstrate a 'procedural impediment' regarding the 'reasonable suspicion' for the 'stop' or with regard to the test. if you had a higher reading, the prosecutor would not entertain the discussion of a close call on a 'procedural failing' by the police. ed dimon, esq. 732-797-1600 ext 235
