What happens with CO drivers license

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
DUI/DWI lawyer at Miller & Harrison, LLC
There is an interstate compact that allows Colorado to revoke your Colorado license just as they would if the conviction for DUI was here.  Genrarlly, if your ability to drive is revoked in Nebraska, Colorado law would not allow you to drive here using your Colorado license until you are reinstated to be able to drive in Nebraska. It is worth having your specific circumstances analyzed by a Colorado attorney familiar with the DMV rules here, or at a minimum contacting the DMV to ask them when you can drive in Coloraddo once your Nebraska case is resolved.

After DUI dismissal, does the 10 years of no BAC still apply?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
You are confusing a few different concepts in the area of DUI law. First, in Colorado, a previous conviction NEVER goes away. So, if you are pulled over and arrested and charged with DUI, the state would look it at as a second offense. Second, the law in Colorado for DUI is a .08 and above. You are not on probation, so the law that applies to everyone else would apply to you. There are laws in Colorado that make it a presumption that you are under the influence of alcohol if your BAC is over a .05 but below a .08, this means that you may still be charged with DWAI, even if your BAC is under a .08.

Could I be arrested for DUI if I was sleeping in my car? How?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
Yes you should fight it an attorney is likely necessary to win depending on where you were located in the car, where the keys were and some other things, you can win at DMV and criminal courts did you do a blood or breath test? if you refused or did a breath test over 0.08, then you must request a DMV hearing at the local DMV office within 7 days of the arrest or else you give up that right and will lose you license (hearing set within 60 days).
