Will I go to jail for my first DWI offense?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
Due to the high BAC, in Colorado, you face a minimum of 10 days in jail. It would depend on the other charges if there is additional minimum time. It would be well worth your time and money to retain a DUI attorney in your area.

If the police pull someone over the age of 21 over and find and open alcohol container in the car, would they be arrested?

If the alcohol container is open the person can be arrested, but would probably be only be given a citation to appear in court. It is against the law to ride in a vehicle and consume alcohol. It is illegal to ride in a vehicle with open alcohol containers.

You failed to move over and blew three times the legal limit. You are looking at about 30 days in jail.
