How much trouble am I in exactly for being arrested for DUI?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
Assuming that this is a first offense and truly no one was hurt (which seems unlikely since the accident would likely be a "head-on" collision) you are looking at a maximum sentence of 6 months in jail, if there were injuries you are looking at possible felony prosecution and significantly increased punishment. In addition to jail you are also facing a DUI program of up to 9 months, significant fines and fees and a license suspension for up to one year. You should contact a competent DUI lawyer within 10days of your arrest as you have important rights that vanish after that time.

Will having to put an ignition immobilizer stop me from early probation termination?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
Department of Motor Vehicles and criminal courts are completely separate. Unless the court orders the interlock, and I have not seen that, then it should not matter.

Is it legal if I'm pulled over and arrested for DWI without probable cause?

Lori A. Beck
Answered by attorney Lori A. Beck (Unclaimed Profile)
DUI/DWI lawyer at Beck Law Office, LLC
A police officer must have reasoable suspicion to make contact with you. If it turns out he was wrong, he must let you go. However, when he comes to your window and lets you know the reason for the stop and he smells alcohol, your eyes are bloodshot and watery, etc., that is probable cause. Chemical tests are not mandatory and are voluntary. But if you do not take one, your license may be suspended for one year for a refusal. If you feel there is no probable cause, you should get an attorney to fight.
