It is possible to petition the court to get your DUI expunged. The judge had discretion on whether our not to grant the petition. There is a filing fee which can vary depending on which court you are in, generally ranging from $60 to $120 in southern California. Attorney fees for handling expungements for clients can vary. I charge $800 and have been very successful in getting DUI expungements granted.

Most states reciprocate (reciprocity) with each other. Therefore, NY will communicate with FLA about the DUI and give him the FLA equivalent of the NY punishment. Check with a FLA lawyer.

If you are relating that you had a blood alcohol level of .21 you may have had a few beers earlier in the week but apparently you continued drinking. That level is significantly higher than any tolerated blood alcohol level allowed and therefore I believe you will be prosecuted. Engage an attorney.
