Whether or not the officer was legally parked will have no effect on your DUI case. Your DUI case will depend solely on if they can prove beyond a reasonable doubt that you were operating a motor vehicle on a public roadway with an illegal blood alcohol level. There may be other problems with your case or issues that can be used as leverage when negotiating with the prosecutor.. You may be able to get a reduction in the charges or possibly even a dismissal.

In Nevada there is no vehicle lock. However, a conviction for a second DUI results in the court imposing a requirement for an Interlock device installed on a vehicle as a condition for reinstating a driver's license after a one year revocation. The device requires the operated to blow alcohol free in order for the vehicle to start.
