Do I have to mention a pending paraphernalia charge at my preliminary hearing for a DUI?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
It seems like two questions, if you have an attorney you should rely on the advice of counsel, if not, you should consider hiring an attorney. At your preliminary hearing you should not be asked about any pending charges unless you are actually sworn and testifying, and then, hopefully your attorney can keep that question from getting an answer. A skilled criminal defense attorney can help you.

How does a DUI appears if it occurs in a different state than the licensing state?

Answered by attorney Mark R. Thiessen
DUI/DWI lawyer at Thiessen Law Firm
That's a weird Montana law and I don't know Montana law, but what I take from it is that they have something less than a DWI. So, even if they report it to Texas it won't satisfy as a prior DWI in Texas. And Texas will treat it the same as Montana. It may be on your record, but looks like it will just be on your driving record and not criminal record.

Can I drive with my Texas driver’s license until my court date?

Answered by attorney Steven Joseph Pisani (Unclaimed Profile)
DUI/DWI lawyer at The Law Offices of Steven J. Pisani, LLC
It does not matter what state your license is from for a DUI revocation. However, a couple of things must happen in order for you to lose your license. If you took a blood test, your driving privilege will probably be valid until the results come back. They will send a notice to either the last address you gave the police or the address on your license. The notice is to request a hearing to preserve your driving privilege. You will have 7 days from the date of the notice to request the hearing. If you do not request a hearing within 7 days of receiving the notice, you will lose your driving privilege automatically. If you request a hearing, your driving privilege will remain in effect until your hearing date or you hear otherwise from the DMV.
