What should I do if I was charged with DUI refusal?

Answered by attorney Marshall S. Tauber
DUI/DWI lawyer at Law Offices of Marshall S. Tauber
Hire a lawyer to challenge the refusal or lose even restricted driving privileges because you didn't challenge. You have 14 days from the date of your refusal to file objections with the secretary of state or you get a hard suspension for a significant period of time, note, "hard" means no driving at all.

How can a person transfer DUI classes to another state without actually transferring the case?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
It is possible to do and this has happened before. The first thing is to approach probation with the transfer if probation ok's it, than she would be able to do the classes in the state and still be on probation in the first state. A very big caveat - most probation terms have travel restrictions. If your client is planning on moving or spending significant time in another state, the court and probation must be informed and proper waivers given.

What charges would come out of a first time DUI charge if I blew a .07 and what type of penalties will go with it?

Answered by attorney Marshall S. Tauber
DUI/DWI lawyer at Law Offices of Marshall S. Tauber
You are on the borderline of having an excellent defense unless there was an accident. .07 is already below the legal limit for a conviction of Operating While Intoxicated. You could be convicted of Operating While Impaired but, you could also be found not guilty. I strongly urge you to find a good defense lawyer anything you pay to hire a good lawyer will, in the long run, be a very good investment. You have a chance, which is way better than you might think so get your case evaluated by me or someone who has experience in these matters & don't be in a rush to plead guilty at your 1st opportunity. If you call me your phone consultation is free & I will tell you all of the possible penalties of the charges you face.
