No, not if the only violation was nonpayment of fees. You just have to prove that you were unable to pay, not unwilling to pay. Make a list of your necessary expenses and your income so that you can adequately explain your situation. Good luck. This applies to Texas.

It sounds like you have been arrested for two misdemeanor offenses.  While I don't believe there is any mandatory jail sentence required for these offenses, you should really speak to an experienced criminal defense attorney as soon as possible.  Some counties may want jail time due to the hit and run.  If this occurred in Lee, Hendry, Charlotte, Desoto, Sarasota or Manatee counties, you can call my office and I will be happy to discuss it with you.

You most certainly will not have to talk (you have the right to remain silent) unless it is to tell the court whether you need a public defender or would like to hire a private attorney. If you hire a private attorney prior to the court date then the attorney can waive your appearance so you do not need to go to court. If you are offered a deal when you do go to court you should not accept it until you have had the chance to have a lawyer review the evidence against you and determine whether the offer is actually in your best interest.
