How long does the cops have to charge you with a DUI after an accident?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
They have up to six years from the date of the offense. If they determine your blood alcohol level from a blood draw, it can take up to a year for the results to come back from the State Police labs. That could be the reason for the delay. I would suggest you be proactive and at least consult with an experienced DUI attorney in your area now.

If the officer no longer employed how will this effect my case?

Answered by attorney Nathaniel D Shafer
DUI/DWI lawyer at Natty Shafer Law
It might not affect the case at all, if he still testifies, but it is impossible to say whether he will. There is nothing legally preventing him from testifying, but he might not want to if he is not being paid for his time. If he does not testify, it will make your case much stronger. That leaves the prosecutor with a lot less evidence.

Can I go to jail for drinking 3 beers and one half a mixed drink without getting pulled over?

Jared Clayton Austin

It is highly unlikely you could be charged with a DUI because they would have to have some evidence of your blood alcohol level at the time you were driving. It would not be enough for them to have a witness to testify to what amount of alcohol you consumed prior to driving a vehicle, even if they had you driving away on tape because they still need your BAC. However, in the future it is not a good idea to drive if you have had more than a couple drinks because the BAC standard for intoxication is so low most people do not realize how quick and easy it is to get to. 08.
