Most field sobriety tests cannot be completed inside a police vehicle, these tests include walk and turn, one leg stand, modified position of attention. The aforementioned tests have been studied more than any other test except, perhaps, the horizontal gaze nystagmus test. The horizontal gaze nystagmus could be administered in a police vehicle but due to the spatial constraints of the vehicle it is unlikely that it was properly administered. You should contact an attorney in your area to discuss the facts of your case, the possible defenses and the likely outcomes.

Yes, they can charge you with DUI. Whether or not charges are filed, however, will depend on what the results of your blood test show. This can take several weeks to over a month. No doubt the court date you were given is many weeks or months away. The more pressing problem may be with the DMV. If the officer took your license and gave you a temporary license, that means your license will be suspended unless you contact the DMV within 10 days and request a hearing. Don't delay on this! Yes, a public defender can help you with your case, if it is filed, but you will not be appointed one until you go to court. There are many things a good criminal defense attorney can do for you now that will help you so you should try to seek one out if you can.

If the BAC numbers are correct, you may be able to beat the charge. It will require you to hire a lawyer and an expert. If you are a student, you may be able to get a public defender and the public defender may be able to get the county to pay for an expert. There is scientific evidence that the breath testing machine is not accurate at those low levels. There are many non-alcohol compounds that will show up as alcohol in those machines. Additionally, there is a long list of substances like soy sauce, white bread and mouth wash that will cause the machine to register alcohol. At that low level, you can fight and win your case by showing that the machine is woefully inaccurate at levels below .03, that compounds other than ethyl alcohol may show a false reading and that common foods may cause the machine to show the presence of alcohol. These defenses require a lawyer and an expert. Good luck.
