The 10 year loss of license in New Jersey is normally given for the third DUI conviction. Why did he receive the 10 year sentence ? We utilize a private detective to obtain the certified drivers abstract. We look at the driving record and see if the sentence is appropriate we try to mitigate the consequences in New Jersey. Field sobriety "evaluations" are NOT pass or fail. They are evaluations, not tests, that the police officer uses to determine IF the person may be too impaired to drive safely. I know the person asking a question is foolish every time I read: (1) I passed all field sobriety tests (2) I was never read my Miranda rights (3) My name was misspelled on the paperwork.
