If I got a DUI in May 2005, should I report this on job applications even after I completed probation?

If you were actually convicted of the DUI, it will appear on a criminal background report. If you were given a suspended imposition of sentence (SIS) with probation, then if you successfully completed probation without any violations, there should be no conviction on your record. Applications for professional licensing often ask, "Have you ever pleaded guilty or been convicted of a criminal offense?" If so, the answer would be yes, you have pleaded guilty but you were not convicted. (With an SIS, you have to plead guilty to the original crime before the judge will suspend the sentence and put you on probation.)

The State is required to prove a charge beyond a reasonable doubt. The fact that you actually were not driving and have a witness who can testify on your behalf are evidence which you can present in your defense at trial. The fact that the officer required that you start your friend's vehicle may negate an allegation that you were in control of the vehicle after the officer confronted you. DUI is a serious offense and the fact that you were not the driver only highlights that you should seek representation and defend against the charge.

It is entirely up to the judge; however, the longer you take to get the issue resolved, the more likely the judge will be to set a high bail, which you will have to post in order to get out of jail before your trial. The case is pending. It won't go away. Take care of it.
