Another state will have its own regulations concerning becoming licensed if one is revoked in NY. Your fiance is the victim of the new changes made recently in the "look back" period which makes 3 drinking related offenses or more subject to lifetime refusal to re-license him in NYS. At present, there are numerous people similarly affected. Attorneys are presently wrestling with the problem and seeking ways to mitigate this damage, but there is no apparent solution at the moment.

Talk to your probation officer about rescheduling. If your probation officer and you have conflicts, and your requests are reasonable, hire a lawyer to talk with the judge about working with you so you can work and meet your probation terms. Bear in mind that the probation always comes first.? If you violate the probation terms and your probation ends up revoked, you will not be able to work, will you?

There are limitations on the State's time to charge you with any crime including a DUI. However, if a warrant was issued in 2009, that would indicate that you were charged back in 2009. You may have some standing to contest this if you can show that the state was somehow negligent in its attempt to notify you of the charges. Otherwise, the fact that the warrant has been active for 3 1/2 years is not due to their misconduct and they can continue to pursue the charges.
