How do I divorce my wife?

Answered by attorney Joanna Marie Mitchell (Unclaimed Profile)
Divorce lawyer at Joanna Mitchell & Associates, P.A.
You have to either reach a settlement agreement and then file a divorce action, or you need to file a divorce action and have her served and then proceed. If you are in agreement on everything, you could potentially be divorced within just a couple months. If not, then it will take longer. You should consult with an attorney in order to best determine your potential rights and options, as well as determine how to proceed.

Is my ex-wife allowed to have the house rented if the mortgage is in her name but the house was awarded to me in the divorce?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
Doesnt sound like it. Are you current on the mortgage? Is the house going in foreclosure? If you are current, then I suggest that you write a letter to her, keep a copy, and tell her that the decree gave you the house and she has no rights in it. If she continues, go to court and ask the court to have her stop. If you are behind on the mortgage, then she may have come up with a way to keep the mortgage current. Regardless, talk with your attorney who handled the divorce.

How does one serve divorce papers when spouse will not give local address and his attorney will not accept papers?

Answered by attorney Ronald L Bornstein (Unclaimed Profile)
Divorce lawyer at Ronald Bornstein, Attorney at Law
An experienced family law attorney, as well as an experienced process server, encounter this situation regularly, and know how to handle this. You should be concerned if your attorney and process server do not. In Florida, you cannot serve a person with a lawsuit in any type of case on a Sunday, so you will not be able to serve him when he has his supervised visit if it is on a Sunday. Since you know he has an upcoming court date, you can serve him there, if he appears for it.
