The Family Code says that the income of a spouse is not to be considered in calculating child support therefore, the net income figure used to determine child support would be based only on the income of the paying party.

Can I still get spousal support if I left my husband?

Spousal support does not consider who left who. It is based on one party's need and the other party's ability to pay. Get an attorney to help you get some support.

If my daughter signed a lease agreement and is filing for divorce does she need to submit a formal eviction notice to her spouse to move him out

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
Since they are married, your daughter should get a temporary order with a move-out date for the husband. In eviction court, he could just say he's her husband and the judge won't have jurisdiction to evict him. This is a family law matter that should be handled in family court.
