My ex''s attorney added something into the divorce psa agreement that my attorney said not to sign.

Answered by attorney Diana L. Anderson

It seems like he is trying to get out of paying alimony to you if the children so not ask for child support.  Child Support cannot be waived.  Even if you do not request child support, and even if you make an agreement that he does not have to pay child support, the children, when they get to be 18 can always go back and get child support for themselves.  I'm not sure what good this clause does, because it seems that he is counting on the children not asking for support when they turn 18, or not wanting contribution to educational expenses.  Its hard to answer without knowing the financial situation between the two of you, who has custody, what the support arrangement is proposed to be, etc.  But if your lawyer says not to sign, its probably a good idea.

How can I get my husband out of my home that I owned brfore marraige and is there a such thing as filing legal seperation papers in nj

Divorce lawyer at Zohn & Zohn, L.L.P.
No easy answers to both of your questions. Generally, spouses have a marital right to stay in a marital home independent of the record owner of the property. Legal separation is similar to what NJ calls "divorce from bed and board." If you want a consultation, please call. Edward Zohn, Attorney at Law, 908.791.0312
