I don't know how the $1,000 is calculated. It may be too high you need an attorney to fight that issue. In California she has the right to use your last name if that is the name she wants to use. You cannot force her to return to her maiden name.

Its his money for his injury. The community may be entitled to reimbursement if it paid medical or nursing costs but the money is his.
