When you put your inheritance into your house (which I am assuming is the Marital Home), you essentially "commingled it," such that it became part of the Marital Estate. However, a skilled Family Law lawyer can still argue that you should receive some type of "credit" when calculating you and your soon-to-be ex's respective shares of equity in the house. "Spousal Support" (the technical term for alimony in Michigan) is assessed by looking at several different factors, often referred to as the "Sparks" factors after the landmark alimony case of Sparks v. Sparks. Of those several factors, some of the most important are: 1) the length of the marriage; 2) the parties' current respective incomes; and 3) the ability of the party requesting spousal support to work and earn a living. I would suggest talking to an attorney to assess whether your wife is entitled to spousal maintenance. Spousal maintenance is based upon the requirements of ARS 25-319. It needs to have been a long-term marriage and she must not be able to meet her reasonable needs. It would probably be helpful to discuss the process of filing for divorce as well.
