What should I do if confronted with divorce by my husband?

Answered by attorney Helene Ellenbogen (Unclaimed Profile)
Divorce lawyer at Law Offices of Helene Ellenbogen P.S.
If he filed for divorce, the court will grant it. The question is how will assets and liabilities be divided. I suggest you get a lawyer and don't wait. Since you didn't mention children, I assume there are none at issue.

Is there a default in a divorce case?

Answered by attorney Brent R. Chipman
Divorce lawyer at Law Office of Brent R. Chipman
If a responsive pleading is not filed withing the time limit set by rule or statute, a default certificate can be entered against the party that failed to respond. That would be the basis for the court granting all of the relief sought by the other party in their pleading.

She is probably not entitled to anything but since you're still married it's at least theoretically possible she could try to make a claim. Remember just because you can't find her doesn't mean she can't find you. If you don't know where to serve her there are ways to serve by publication. You should look into that.
