If by custody you mean the majority of time, he won't get that when he gets out as the children will have been living with you. I suggest you get a lawyer and file the divorce along with a parenting plan that is graduated and begins with a few hours of supervised time when he gets out.

My spouse wants to have the house in his name, then deed it to our son (14) when he is 18 is that something that could be put in the divorce decree?

I need more information to give you an informed answer. Is the house community property? Why does he want to transfer the house to an 18 year old? If the motive is to get the house out of his name due to creditors, not a good idea - there are other ways to accomplish this without the risks involved - i.e. fraudulent transfer, tax implications, volatility of an 18 year old, etc. General answer is yes it could be provided for, but it is probably not a good idea.

IT does not appear you live in Colorado or you don't understand what your lawyer has said because there isn't any difference between contested and uncontested for filing the divorce. Contested means that it will be necessary to have a trial for a judge to make decisions about the things you and your spouse cannot agree upon. Trials take much more time and effort by the attorney. So, the only way to avoid that extra cost is to get serious about reaching a workable agreement, try to represent yourself, or find another attorney who will do it for less.
