In hindsight, it was obviously a mistake to give him 3 years and you should have insisted that he refinance immediately or have the property sold. If the court order provides for 3 years, you're pretty much stuck.

You don't say if what he has to pay you is support or funds that constitute a division of property. If it's support, he can not bankrupt out of it. If it's a division of property that was reduced to judgment, it is treated as a secured priority debt. If he is not currently in bankruptcy, you can go to court on either a motion for contempt (support) or a motion to compel.

From what you describe, no, you'e not entitled to his income because you two never held yourselves out as being married, which is required to be common law married in Texas.
