Do you have to get an official divorce before you can get officially married to someone else?

Robert Jensen 'Bob' Matlock

An informal marriage may or may not require a divorce. There is a presumption that an informal marriage has ended or did not exist if no divorce suit is filed for a given period of time after the parties separate. There are too many unexplained facts in your question to provide a specific answer. I suggest you hire a lawyer.

The only issue would be with immigration. However, after 14 years and a child here, that is unlikely to be an issue. Consult with an attorney to discuss in great detail.

In the first stages of filing for an absolute divorce what are the chances of me receiving full custody/support and alimony?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
I'm not sure what you mean by "absolute divorce." Arizona is a no-fault state, so your spouse's adultery will have no bearing on the outcome of the divorce. Custody, spousal maintenance and child support are determined based on a list of statutory factors; however, you have not provided enough information for me to analyze the situation. I recommend you consult with an attorney to discuss this matter in greater detail.
