Can a final divorce decree entered in Denton County Texas get revoked?

Robert Jensen 'Bob' Matlock
Answered by attorney Robert Jensen 'Bob' Matlock (Unclaimed Profile)
Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
An order can be set aside within 30 days after it is signed. Beyond 30 days, there are other methods that may be available but they are more complex. I suggest you hire a lawyer.

Do I have any recourse to go back on a 30 year old divorce for share of husband's 401K?

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)
Divorce lawyer at Law Offices of Kimberly D. Moss, PLLC
Yes, there is something you can do. You will need to file a Suit for Postdivorce Division of Community Property. This will allow you to bring it to the court's attention (and your former husband's) that you are entitled to his retirement account and the income from the rental properties if they were acquired during your marriage. It is essentially re-doing the property division aspect of your divorce and is the ony way you will get your fair share of the community property acquired during your marriage.

Can I get half of my husband's social security since he refuses to work and we are separated?

Social security cannot be divided. Your best bet is to get your own job. I suppose you could file for divorce and ask for a split of the property and the 401k. That may help.
