It is not that simple. There is a formula for calculating these things. It is called the Moore-Marsden formula. If the down payment was made from husband's money he had before he married you or money he inherited (ie, separate property), he gets that amount reimbursed but you are entitled to reimbursement for about one-half of all payments made during marriage. But the math isn't that simple. You will need an attorney to help you calculate the Moore Marsden amount.

Though there is nothing preventing you from changing the locks, you don't have a court order giving you exclusive use and possession of the home, at least not yet. Also, if he has a driver's license showing he lives there, he can easily force his way into his own house, or have a locksmith open the door for him and cut him a new key. If you feel you need exclusive use and possession of the house, the better practice would be to have your attorney ask for it in your pleadings, and obtain a court order. Consult with an attorney to discuss the specifics of your situation and your options.

If the case is contested, it takes approximately 1 year from the date the Petition is filed through the trial date, if there are no delays. However, if there are temporary issues that need to be heard, such as timeshare and child support, a temporary relief hearing may be requested early in the case.   If the case is uncontested, you can get a court date within a few weeks after an agreement resolving all issues is signed.
