Most people would prefer an annulment or divorce if for no reason other than the fact that an annulment treats you under the law as if no marriage had ever occurred. Some people like the idea of getting an annulment to avoid the stigma of saying they are divorced. However, you cannot simply choose between an annulment or a divorce. Annulments can only be obtained under certain circumstances.

A lawyer is not required in order to file for and obtain a divorce. People usually use lawyers when communication has broken down. If you and your spouse agree to end your marriage, and believe that you have reached a fair and equitable division of the property, then you can file the required paperwork with the court. Please note that there is a statutory period of time that you must wait before the divorce becomes final. If there is property or there are children, it might be a good idea to briefly consult with an attorney to make sure that the the property division, child support, etc. is fair and that it meets the requirements.

I want to start divorce procedure in Texas from my husband that lives in California.Is this possible if I do not have an address?

You can obtain a divorce from your spouse in Texas because you have lived in Texas more than six months. It is not a problem that your spouse lives in another county.  To start the proceess, you need to file an original petition for divorce and then it must be determined how to give him notice of the divorce. You must exercise "due diligence" in locating a potential address for him. If you cannot find an address, then you can to serve him by "citation by publication" which means that you are putting a notice in a local newspaper where he lives to notify him of the divorce.
