Can a mother take her children to another state and then files for divorce there?

Answered by attorney Eric Allen Maskell (Unclaimed Profile)
Divorce lawyer at Law Office of Eric A. Maskell
You can usually file divorce in the court that has jurisdiction. You should look at the jurisdiction rules in Kansas before filing. Some states require a minimum residency requirement of 60 days or 90 days. Once jurisdiction is proper then you can file in those courts without repercussions.

I have been separated for 5 years from a man who is addicted to drugs and hasn't worked in about 7 years. My question is when I divorce him will he be

Answered by attorney Renea Overstreet
Divorce lawyer at The Overstreet Law Firm
You can ask for the house to be awarded to you. The question will be whether you have to pay him for his interest in the house. You could make a good argument for not paying him, but he may have an equally good counter-argument. If the two of you don't come to an agreement, the judge will decide. Do you have children with him?

What will happen on our prenuptial agreement and division of properties?

Answered by attorney James Timothy Weiner (Unclaimed Profile)
Divorce lawyer at James T. Weiner, P.C.
This is a difficult question.. Prenuptual agreements are generally enforceable in the absence of fraud. if you were told it was mandatory and entered into it without your own attorney then you have a possibility of showing fraud and it could be void.
