Is a written divorce valid?

I do not understand your question, the only valid divorce is one interviewed by the court as its order.

Can I get survival benefits if my husband promised them to his 1st wife?

Answered by attorney Jill K. Whitbeck (Unclaimed Profile)
Divorce lawyer at Law Offices of Jill K. Whitbeck
Not if he followed through with the paperwork giving them to his first wife. If she has court orders properly processed, she gets the benefits. If she only has a verbal promise that was never reduced to a court order and submitted to his retirement plan, she cannot claim those benefits.

What does it take to get an annulment?

default-avatar
Answered by attorney John E. Kirchner (Unclaimed Profile)
Divorce lawyer at John E. Kirchner
Colorado no longer provides for an annulment. Instead, there is a proceeding to obtain a Declaration of Invalidity when there are legitimate reasons why the marriage should never have occurred. Attempting to explain that law in this forum is not practical, but it is far more restrictive than what most people think an annulment means. The law has very strict limits and time deadlines so you will need to contact an attorney to discuss the reasons you think the marriage should be declared invalid. However, second thoughts or simply deciding you made a mistake is not enough and you probably need to pursue a divorce - not an invalidity declaration. In either situation, however, your home would be considered your separate property and the only possible claim the husband could assert would be to a share of any increase in value that occurred during the marriage. In today's poor economy it would be almost miraculous if your house increased in value during the 4 months you have been married.
