Is my spouse entitle to any of the retirement plan?

default-avatar
Answered by attorney Jessica M Cotter (Unclaimed Profile)
Divorce lawyer at The Law Firm of Jessica M. Cotter, P.L.L.C.
If the circumstance is exactly as you describe it, then no she is not entitled to a portion of the plan because it was acquired before the marriage and therefore the plan and any increase in value of the plan would be your separate property. I would still bring a copy of the plan to an experience divorce attorney to have it reviewed.

Can my husband take the vehicle from me with going to court?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
He may have a larger claim to the value of the vehicle than you do. Gifts from third parties are generally not subject to division in a divorce, but gifts between spouses can be divided by the court. Consult a skilled family lawyer. It's almost always worth it.

Can we have a mutual divorce without help from an attorney?

Answered by attorney John F. Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
Yes, it is possible, a single attorney could be a mediator/arbitrator and only the scribe, but the better way is to have one lawyer hired by one of the parties who does the work and represents one of the parties only, with the final agreement taken to the other party's attorney, hired for an hour or two, to review and explain the proposed judgment to their client.
