If you are still married, you can only get him off the deed if he agrees. If you are divorced, and you are retaining the house, your husband will generally be required to sign a quit claim deed giving his interest in the house to you.

I am sorry - what a tough situation. Military benefits are covered by federal regulations, while your divorce will be covered by state law. Consult a civil attorney who has experience with military law. Most of the benefits you receive are only authorized to be given to service members (with the exception of long-term marriages); therefore, you will lose these benefits at divorce As to your immigration status, did your husband sign an I-864 Affidavit of Support to help you get your LPR? If so, he must support you at 125% of the federal poverty level until a terminating factor occurs (ie, you have 10 years of work here, you go back, etc.).
