Your divorce may be complicated by the New York Soldiers and Sailors Act, but you can still get a divorce from him. If you are not living together, you may have a hard time arguing that he should pay any alimony ("maintenance"). Additionally, this was a short term marriage so it further decreases your chances for maintenance.

Workers Comp is generally considered separate property and not subject to division in divorce cases. Don't trade your separate property for anything that is marital - you are entitled to your share of the marital assets - including part of the house. Once you get your settlement, place it only in an account in your name, otherwise you might contaminate it/comingle it with marital property. You might be entitled to some alimony because of the length of the marriage. It sounds like you would have a fight about what his true income might be.  Given the length of marriage and the assets you have, talk to a lawyer so you will know your rights. You might want to settle and try to get this done quickly, but don't cut yourself short on assets that you worked so hard for these 25 years of the marriage. If you want to keep things as friendly as possible, look for a lawyer who also offers mediation services (or ask your husband about going to a divorce mediator). Good luck.
