Am I entitled to my husband's land even if there is a quitclaim already?

Cassandra T Savoy
Answered by attorney Cassandra T Savoy (Unclaimed Profile)
Divorce lawyer at Cassandra T. Savoy, PC
In the first place, your husband is only entitled to 80 acres. The brother owns the other 80 acres. The property is an inheritance. It was not acquired due to your efforts with your husbands. Therefore, the property is not subject to equitable distribution. If you can prove that the asset was co-mingled, then you may be entitled to some portion. You need to work with the attorney who is handling your divorce. This is a complex issue.

Is my second marriage valid after divorcing my first wife?

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
This is a very unique question.  I think your second marriage would not technically be valid because at the time that marriage was conducted, you were already married.  Therefore, I do not believe that going back and correcting the issue by later becoming divorced will work, but the real issue is whether or not you recognize thatsecond marriage.

How can I keep most of our assets in the divorce settlement?

Answered by attorney Vincent James Bernabei (Unclaimed Profile)
Divorce lawyer at Vincent J. Bernabei, LLC
The bad news is that your husband's "omissions" about his health probably won't help you get more than 50% of the marital assets. The good news is that you may be eligible for more than 50% of the marital assets if you can prove that your husband did not serve as a homemaker and did not contribute equally to the acquisition of your assets. You should consult with an attorney with experience in family law cases to see if there is more good news or bad news in your case.
