WHEN YOU DIVORCE IS IT THE NEW JERSEY LAW THAT YOUR SPOUSE GETS HALF OF WHATEVER YOU HAVE WETHER THE SPOUSE HAS CONTRIBUTED OR IS NOT ON ANY DEEDS ?

Answered by attorney Diana L. Anderson

There are a lot of special circumstances and no one answer fits all.  There should be equitable distribution, but what is equitable is not always half.  There needs to be some recognition of ownership of whatever property is the marital home, and the source of funds for other properties is relevant.  Were any of the assets inherited?  Any asset that is inherited, and does not become a joint asset is not subject to distribution

Unfortunately, you will not be able to file charges against the woman.  However, if she is harassing you, or invading your privacy, then you could file a claim for harassment.

Been married for 18 years brought a house with his parents and now getting a divorce. mother, dad and husband name on the deed but it does say son

Answered by attorney Diana L. Anderson

you will need to have proof of payment of the mortgage, and what you paid to purchase the property.  the way the deed is set up, it might be questionable your share or interest in the property.  Is this the house you lived in while married?  you will be able to get some interest in the property back, and it might be credited against other things owed.  Good luck.
