Depends on the language of the document. It should apply nationwide as long as the state being used recognizes pre-nups.

This is a common situation, that someone hears something from someone else and then has to ask an attorney if what they heard was correct. Each case is different and each case demands the attention of a competent attorney. What is acceptable in one case could be a hotbed of contention in another. Only the father can make an issue of this circumstance, and probably will not. It may not even become an issue. Most issued are resolved through hiring competent counsel or mediation.
