Can a judge force a man to take half of his wife's pension upon her retirement in a divorce settlement?

Matthew R. Nahrgang
Answered by attorney Matthew R. Nahrgang (Unclaimed Profile)
Divorce lawyer at Nahrgang & Associates, P.C.
That means that a judge can do what's fair.  If he determines that the only way to assure each party has some retirement and has sufficient resources to meet their daily needs, he can certainly order that.

Will it hurt a divorce case if the one seeking a divorce goes on a trip?

Answered by attorney John E. Kirchner (Unclaimed Profile)
Divorce lawyer at John E. Kirchner
The fact of a weekend trip is irrelevant to anything unless by being gone she isn't present at any court proceedings where decisions are made. The more important concern may be where are the children going to be while she is gone.

Do NJ courts count business or calendar days for motion reconsideration?

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
You should always count calendar days.  There are some occassions when exceptions are made - such as during Super Storm Sandy or other natural disasters.
